These Terms of Use govern your access to and use of zopanta.com, the Zopanta Launch List and related website communications. They do not govern the future Zopanta mobile application, paid subscriptions, purchases of a physical device, shipping, returns or hardware warranties. Separate or updated terms will apply before those products or services are made commercially available.
1. Agreement and operator
These Terms form an agreement between you and Zopanta Ltd, 21 Kalamon Street, Livadia, 7060, Larnaca, Cyprus (“Zopanta”, “we”, “us” or “our”).
By accessing or using the website, you agree to comply with these Terms. If you do not agree, you should not use the website or join the Launch List.
Our Privacy Policy and Cookie Policy, each available on the website, explain how we process personal data and use cookies and similar technologies.
2. Eligibility and the Launch List
Anyone may browse the public website. You must be at least 18 years old to join the Launch List or otherwise submit personal data to Zopanta through the website.
When joining the Launch List, you must provide an email address that belongs to you and provide the requested confirmations. The signup flow will include a separate confirmation that you agree to these Terms and are 18 or older. Any consent to receive launch or product availability emails is separate from acceptance of these Terms.
Joining the Launch List does not create a customer relationship, guarantee access to any future product, reserve a device, guarantee a launch date or create any obligation on Zopanta to offer a product or service to you.
3. Permitted use
You may use the website for lawful personal or business information purposes, subject to these Terms. You must not:
- use the website in breach of any applicable law or regulation;
- interfere with the operation, security or integrity of the website or attempt to bypass access controls;
- introduce malware, malicious code, automated attacks or other harmful material;
- misuse the Launch List, submit false information, impersonate another person or use an email address without authority;
- scrape, crawl, harvest, copy or extract website content or data at scale using automated means without our prior written permission, except where applicable law expressly permits it;
- reverse engineer, decompile or attempt to derive source code from website software except to the limited extent such restriction is prohibited by law;
- infringe the intellectual property, privacy or other rights of Zopanta or any third party; or
- use the website in a way that could damage, disable, overload or impair it or interfere with another person’s use.
We may take reasonable steps to protect the website and other users, including blocking or restricting access where we reasonably believe there has been misuse, a security risk or a breach of these Terms.
4. Intellectual property
The Zopanta name, branding, logos, website design, text, graphics, product descriptions, illustrations, software, visual materials and other content made available on the website are owned by Zopanta or used under licence, unless stated otherwise. They are protected by intellectual property and other applicable laws.
Your use of the website does not transfer any ownership rights to you. You may view the website and make reasonable personal use of its content. You may not reproduce, republish, distribute, modify, sell, license, commercially exploit or create derivative works from Zopanta content without our prior written permission, except where applicable law expressly allows it.
Nothing in these Terms grants you any right to use the Zopanta name, logo, trade marks or branding as your own or in a way that suggests endorsement, partnership or affiliation without written permission.
5. Feedback and suggestions
If you voluntarily send us ideas, suggestions, comments or other feedback about the website or a future Zopanta product, you allow Zopanta to use, adapt and incorporate that feedback for any lawful business purpose without payment or obligation to you.
This does not transfer ownership of intellectual property that you already owned before providing the feedback. You should not send confidential information or third party material that you do not have the right to share.
6. Informational content and no professional advice
The website is provided for general information about Zopanta and the problem we are working to address. Website content is not medical, psychological, legal, financial or other professional advice and should not be relied on as a substitute for advice from an appropriately qualified professional.
Zopanta is not a healthcare provider. The website does not provide diagnosis, treatment or emergency services. If you have concerns about your health, mental health or wellbeing, seek appropriate professional assistance.
7. Product under development
Zopanta is still developing its mobile application and connected physical device. Any website description of planned products, features, functionality, pricing, launch timing, availability, compatibility, research plans or future services is provided for information only and may change before commercial launch.
Unless Zopanta expressly enters into a separate binding agreement with you, website statements about future products or services are not promises, offers, warranties or binding commitments. Joining the Launch List does not guarantee that any particular feature, price, product or launch date will be available.
8. Accuracy and availability of the website
We aim to keep website information useful and reasonably current, but we do not guarantee that every description, statistic, availability estimate or other item of content is complete, accurate, current or free from error.
We may update, change, suspend, withdraw or remove website content or features at any time. We do not guarantee that the website or Launch List will always be available, uninterrupted, secure or error free.
9. Third party links and services
The website may contain links to third party websites, social media pages, event pages or other external services. These links are provided for convenience and information only. Unless we expressly say otherwise, a link does not mean that Zopanta controls, endorses or is affiliated with the third party.
Third party services operate under their own terms, privacy practices and security arrangements. Zopanta is not responsible for their content, availability, security, products, services or privacy practices.
10. Privacy and cookies
Our Privacy Policy explains how Zopanta processes personal data collected through the website, Launch List, direct communications and related interactions. Our Cookie Policy explains how cookies and similar technologies are used, including Google Analytics 4, Meta Pixel and Google reCAPTCHA where applicable.
Where consent is required, analytics and marketing technologies are intended to operate only after the relevant consent has been given. You can manage cookie preferences through the website Cookie Settings control.
11. No warranties
To the maximum extent permitted by applicable law, the website and its content are provided on an “as available” basis. Zopanta does not give warranties or representations that the website will always be available, uninterrupted, secure, error free, compatible with every device or browser, or suitable for every person’s particular purpose.
Nothing in these Terms affects any warranty, guarantee or other right that cannot lawfully be excluded or limited.
12. Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful. In particular, nothing excludes or limits liability for fraud or fraudulent misrepresentation, death or personal injury caused by negligence where applicable law prohibits such exclusion, or any other liability that cannot legally be excluded or limited.
Subject to the paragraph above and to the maximum extent permitted by applicable law, Zopanta is not responsible for indirect, incidental, special or consequential loss arising from use of, or inability to use, the website, or from reliance on website content.
To the maximum extent permitted by applicable law, Zopanta is also not responsible for loss or damage resulting from third party websites or services, internet or telecommunications failures outside our reasonable control, malicious software introduced by third parties, unauthorised misuse of the website, or a user’s failure to take reasonable security precautions.
If you are a consumer, you retain all mandatory rights and remedies provided by applicable consumer protection law. These Terms do not limit rights that the law of your country of residence does not allow you to waive.
13. Changes to these Terms
We may update these Terms from time to time, including when the website changes, when Zopanta introduces new services or when legal requirements change. The revised version will be posted on the website with an updated date.
Where a change is material, we will take reasonable steps to communicate it where appropriate. These Terms are governed by the laws of the Republic of Cyprus.
Subject to any mandatory rights you may have under applicable law, disputes relating to these Terms or the website will be subject to the jurisdiction of the competent courts of the Republic of Cyprus.
